In 1913 by an act of Congress approved June 30, 1913 as follows:
“That where any cemetery now exists within the lands of the five Civilized Tribes, said land with said cemetery, together with the land adjoining same where necessary, not exceeding twenty acres shall be transferred by the Secretary of the Interior to the proper party, association or corporation or to the county commissioners of the state of Oklahoma, for cemetery purposes only.
The county Commissioners of Carter County, Oklahoma are the proper persons under said law at this time to hold title to said cemetery.
The Chief of the Choctaw Nation and the governor of the Chickasaw Nation signed and affixed the Great Seal of their respective nations.
This was filed for record on the 6th day of May, 1915 and recorded.
The ten acres was already being used as a cemetery when Congress acted and the law was passed. There are many graves that date back in the 1800’s.
The name given to the cemetery came from a well-known and respected pioneer of the area. His name is Joseph Scott McAlister (1849-1936) and he settled in Overbrook in 1887. He owned a farm and a general store. He was also appointed postmaster for Overbrook. He was well liked and a person that cared for his fellowman. The McAlister Baptist Church and the McAlister Cemetery were named in honor of him. Mr. McAlister died in 1936 and is buried in the Old McAlister Cemetery located in a remote area near Overbrook with some of his family members.
The first Board of Affairs Officers for McAlister Cemetery was elected on May 30, 1923. The elected officials were:

04/17/21 “I do remember that my dad hand-dug some graves at the cemetery back in the late 40’s. That was when we didn’t have anyone to oversee the care of the cemetery. I also remember that when my dad died, some men hand dug his grave. This was in the early 50’s. Then Grace Gentry stepped in and began to oversee the cemetery. I don’t know the date. She did thisuntil her death and then her daughter, Doras Richards took it over. During this time Johnny Jackson joined the board and later became the president of the board. Doras had health problems and couldn’t continue so Johnny Jackson continued to oversee the cemetery with other board members. He has done an amazing job and I hope this will continue for a long, long time!! Today, when someone passes, Johnny Jackson calls the County and they come out and open the grave and then closes it after the funeral.” -Cleta
